Blood and Breath Tests and DUI in Mid-Michigan

According to Michigan implied consent law, a driver must submit to a breath test or blood test if he or she has been arrested for DUI (driving under the influence) or OWI (operating while intoxicated). A refusal of chemical testing to determine one’s blood alcohol or breath alcohol level may result in the suspension of your driving privileges and further criminal penalties for second or subsequent refusal.

The Michigan Drunk Driving Attorneys at Kronzek & Cronkright know that breath and blood tests are not always accurate. Because they are administered by people who can make mistakes, and because they do not take into account each individual driver’s unique physical make up, it is easy for a breath test or blood test to show a reading which is too high. However, because of the consequences of refusing a chemical test, our attorneys find themselves defending numerous clients who have agreed to a blood test or breath test and have been unfairly charged with DUI or OWI as a result.

Breath Tests and Blood Tests

A breath test is the least reliable form of chemical test which may be used to determine a driver’s blood alcohol concentration after a Michigan OWI or DUI arrest. The machine itself may malfunction or may be improperly calibrated, or the test may be administered imporperly. Additionally, certain physical conditions or diets may affect the results of a breath test.

While more accurate, a blood test may also show an incorrect blood alcohol concentration reading if it is administered incorrectly, if the sample is mishandled or if any mistake or error occurs during the testing process.

Your Mid-Michigan DUI defense lawyer will throughly review the reports regarding your blood test, breath test, and DUI arrest. The information contained in them will help determine your best defense against DUI or OWI charges.
